TERMS AND CONDITIONS OF SALE
1.0 Products supplied are clearance items and cannot be returned outside the provisions of the Consumer Guarantees Act.
1.1 Cycling Clearance reserves the right to cancel an order due to a stock line coming to an end, with all monies refunded to purchaser.
What if you wish to make a claim in relation to a product?
Subject to 1.0 if you wish to make a claim in relation to a product for defect or incorrect supply you must notify us within seven (7) days of delivery, non-notification is deemed to be acceptance of the condition and number of products; If the product is being returned due to incorrect supply, the product must be unused, in its original packaging and in the same saleable condition as provided. Any and all warranty claims will be handled in accordance with the manufacturers advice and the provisions of the CGA
Any product the subject of a claim under 1.0 must be returned to Cycling Clearance NZ ltd and be accompanied by the relevant order/invoice number and proof of purchase.
Delivery and Cancellation
2.0 We will use our best reasonable endeavours to deliver our products on the agreed date and time (within 7 working days of the date of your order). The time and date of provision is an estimate only and not an essential term of our agreement. We may partially deliver products listed in one order or invoice without added cost to you.
Part orders may arrive separately due to to being dispatched from separate sources. Items are not necessarily held in stock by cyclingclearance.co.nz and may be sent directly from their respective NZ distributors.
2.1 We will use our best reasonable endeavours to provide our products on the agreed date for delivery by the Supplier in good faith but date of delivery is not to be treated as a condition of any sale. No claim shall be made by the Customer on account of late delivery of goods and any late delivery shall not be deemed to be a breach of this agreement by the Supplier and the Customer shall not be entitled to cancel this agreement because of late delivery. Your rights under the Fair Trading Act NZ apply
2.2 The Supplier shall not be responsible or liable in any way to the Customer for delays or defaults in delivery of the order or any part thereof nor for any direct or consequential loss or damage arising therefrom.
